J-1 waiver application statement of reason (DS 3035)

I am applying for J-1 waiver based on exceptional Hardship to U.S. citizen. I have submitted my application (Form I-612) to USCIS and I am preparing to submit form DS 3035 to the State department. As part of the DS 3035, it is required write a statement of reason. So my question is:
Can I use the same hardship statement that I submitted with Form I-612? My hardship statement is long (more than 8 pages) in addition to appendixes

Hi,
I sent my document along with the fee and documents for J1 waiver to St. Louis on Jan 3rd. It was received on jan 8th.

I don't see any information regarding my case. The main cause of my worry is that the fee is not cashed yet. I called my bank and asked about it. What should I do?

I graduated in the US 2006 (B.A.), got my OPT in 2007 and went back home in 2008 to work (Brazil).
Am legible to apply to the J1 now (dec2014/ 34 years old) and transfer to H1B the year after?

Issue about industrial offer supporting J1 waiver

Hi everyone,
I have been in the USA since 2013 and I am working in a university as a postdoc. Recently, I got an industrial offer from a company. The company can sponsor H1B for me, but I have to waive my J1 home residency requirement first. I believe I can get a “No Objection Statement” from my country. My question is: from the view of DOS or USCIS, will this industrial offer be a rational reason to make my J1 waiver approved? Thank you.

I got my J1 waiver approved today and just wanted to share my timeline (I'm very thankful to this forum since it has helped me understanding this entire process and also finding other people's timelines).

Received Form DS-3035 (and other docs) – May 28th, 2013
Received No Objection Statement (from Peru) – June 18th, 2013
Received Favorable Recommendation – July 28th, 2013 (sent to USCIS on July 31st)
USCIS Waiver Approval – August 19th, 2013 (I still need the actual document but...

Is there anyone that applied for a persecution waiver for 212(e) and got rejection/approval? Did you apply with or without a lawyer? I am not able to afford a lawyer without taking out loans, but I really fear returning.

If you have any experience at all, please share. I am also former Fulbright.

Question regarding travel during waiver process

Hi friends,

I previously held J-1 visa and currently getting my waiver of 212(e). Now I am in F1 status. My waiver case is with DOS now and it is still pending (NOL from my embassy has been received).

My question is, can I travel to my home country while the case is pending and when I come back to US (in F1 Status), will I be accused of immigrant intent?

Hi,
I was in US as a post doctoral fellow in Astrophysics from 2005-2008 on J1 visa. I got married and came to Canada to live with my husband. We have been living in Canada since past 3 years and I have a Canadian PR. Now my husband is getting transferred to US and we all have to move to US within a year. However, my J1 visa had 2 year home residency requirement. I understand that I have to take no objection letter. I see that one has to fill 4 forms of 'Grant of Waiver Certificate' available...

I just need some sort of clarification. My understanding was that since I received my J1 from the UK, I should automatically get the 2 year waiver. However, because my country of origin is on the list, I just received a letter that I need to apply for a waiver from the consulate in Washington. Surely, this can't be right as I thought I already had the waiver. Can someone please shed some clarification on this?

Dear all,

I am about to request NORI from India (MHRD, West Bengal Government and Kolkata RPO). Does any one have had a similar experience before me? Could you please share your thoughts?

Basically, I would like to know:

1. Does the Indian consulate in NYC consider 2 out of 3 NORIs to be enough to issue a waiver certificate?

2. A lot of people have advised using FedEx and not USPS for mailing out documents to India, and I plan to follow the advice. My concern is can I take the risk of...

Hello,
I am going through a tough situation. I applied NORI on Jan 2015 and received my 2 clearances from State by first week of February. From last three months I have hard time with HR in New Delhi. I am still waiting for their certificate. I applied in San Francisco consulate and they need all three. By the time I started the US-part from first week of March which is also pending.
Now I got the job, asked me to join May 4th, 2015. They will sponsor H-1B not J-1.
In such situation how can I...

I have 3 questions and would appreciate the help.

1. I am confused if I need a "Statement of Reason" with my J1 visa waiver application documents. There is no mention of it on U.S. Department of State site. However, some other webpages talk about it.

2. What size envelopes do I include? I am getting different sizes when I look-up legal size on google. Please let me know the size required or used by you.

3. Are personal checks accepted for payment of fee or I need to send cashier check?...

Hi ,

I was on J1 visa and on expiration returned back to my country in May 2015.I came to know that I was subject to 212E in Oct 2014 and immdiately started teh process of getting the waiver .
I followed the steps for J1 visa waiver as listed on indiacgny.org website
After receiving the copies of NORI certificate from all three offices in India , I sent my DS3035 with relevant documents and application fees to The Consulate General of India.
When I followed up , they wrote back to me that...

I have applied to a J-1 waiver based on the fact that my DS2019 states I am subject to the 2YR HRR.

The DOS website states the DECISION to be "NOT SUBJECT" and that a 212(e) FINDING LETTER has been "SENT"

Could anyone help me interpret this? What does this mean? Was I granted the waiver or not?

I concurrently applied for a J1 2yr HRR waiver based on No objection and an advisory opinion.
I was quite sure I was wrongly subjected. After 2 months of waiting the case was updated online as "Not Subject" in the waiver column and that 212 (e) finding letter has been sent on March 11th, in the advisory opinion column it says "Not Required to adjudicate"

It is almost 3 weeks and I'm yet to receive the letter. Please does anyone know about this and if it usually take this long to get the...

Hi. I was wondering what documents to attach when sending the NORI statement and affidavit to the three offices in India (MHRD, home department of state and the Regional Passport Office)?

As such the instructions on the NORI forms do not indicate anything. So should we just send a cover letter, NORI statement, NORI affidavit?

Or

Should we attach photocopies of additional documents - such as educational certificates, passport pages, etc? And should they be same for each of the office,...

I've searched the forum and couldn't find the answer for this specific situation, so I'm posting this new thread, I'm sorry if this was answered before.

I'm from Brazil and studied in US in 2014, I was on J-1 visa, and I'm subject to the 2-year HHR, while in US I had contact with a company that is willing to offer me a job, and is going to apply for an H-1B in my behalf.
